When conflict makes progress difficult, mediation offers a private and structured way to clarify the issues, consider options and work toward an agreement you can live with.

Mediation gives participants the time, information and structure needed to discuss difficult issues without asking a third party to decide the outcome for them.

Keep decisions in the hands of the people they affect

The mediator remains neutral. Their role is to organize the process, support clear communication and help identify areas of agreement. Each participant decides whether a proposed resolution meets their needs.

More control. Participants determine the terms and whether an agreement is reached.

More flexibility. Sessions can be adapted to the dispute, the participants and the information involved.

Matters suited to mediation

We structure mediation around the legal, financial and practical concerns that are preventing resolution.

Separation, parenting arrangements, support, property and changing family responsibilities.

Partnership, shareholder, contractual and commercial disagreements.

Employment concerns and disputes affecting teams or ongoing working relationships.

Estate administration, competing expectations and disagreements between family members.

How mediation works

A clear process, adapted to the dispute.

We discuss the circumstances, the participants and whether mediation is an appropriate option.

The issues are identified, relevant information is exchanged and the format for mediation is established.

The mediator guides focused discussion, tests assumptions and helps participants explore possible terms.

Any agreement can be recorded for independent advice and completion of the appropriate legal documents.

Your mediator

Yanik has been a partner at Sicotte Guilbault since 2004. His family-law and civil-litigation practice is supported by extensive courtroom, negotiation and mediation experience. He offers mediation services in both official languages.

A workable way forward

The goal is not simply to end a disagreement. It is to establish a workable way forward.

A skilled mediator is neutral, but active. They keep the discussion productive, make sure key questions are addressed and help participants assess proposals realistically.
